Chinese copyright infringement here refers to instances where sellers based in China engage in the unauthorized use of copyrighted material on Amazon.

  • Send them a cease and desist letter 
  • File a formal infringement report to Amazon
  • Submit a DMCA notice to Amazon

Sending an Amazon Cease and Desist Letter

An Amazon Cease and Desist Letter is a formal notice you send to another Amazon seller suspected of infringing on your intellectual property rights. This letter demands that the seller immediately stop the alleged infringement (“cease”) and refrain from any further similar activities (“desist”). 

Sending a Cease and Desist Letter is often a preliminary step before taking legal action. It expresses your intention to protect the value your intellectual property and allow the seller an opportunity to rectify the issue voluntarily.

A Cease and Desist letter typically includes the infringement details, provides evidence supporting the claim, and demands corrective actions, such as removing the infringing product listings. The letter should include the following: 

  • The infringer’s email address
  • The subject line stating the purpose of the letter
  • Your brand name 
  • The listing number/account of the infringing product 

Reporting Copyright Infringement on Amazon

To report the infringement directly to Amazon, you must fill out and submit a Report Infringement Form on Amazon. If your brand is under the Amazon Brand Registry, you can file an infringement report using the RAV (Report a Violation) feature.

Gather Evidence

Before reporting infringement, first collect comprehensive evidence to support your claim. This may include:

Fill out the Amazon Report Infringement Form to submit your complaint to Amazon. You will be required to provide detailed information about the infringement, including the type of infringement -copyright, in this case – product details, links to the infringing listings, and the evidence you’ve gathered. 

It is recommended that you seek the assistance of an attorney when filling out this form to ensure that it clearly articulates, in proper legal terms, the infringement that has occurred. After you have completed the report and attached all relevant evidence, submit it to Amazon and await review.

Follow up on the Report

Following the filing of your claim, closely monitor the resolution process. Amazon will investigate the reported infringement and may contact you for further information or clarification. To speed up the resolution process, respond to these requests promptly and professionally. After investigating, Amazon may act, such as removing the infringing listings. 

It is worth noting that the seller of the infringing product may contact you to request that you retract the claim. They may also try to negotiate a compromise or file a counter-notice with Amazon, claiming their listing does not violate your copyrights

Submitting a DMCA Notice to Amazon

The Digital Millennium Copyright Act DMCA, a key tool for U.S. sellers, applies to online service providers globally, including Amazon. Sellers can submit DMCA notices to Amazon to request the removal of infringing content. The safe harbor provisions of the DMCA protect online platforms from liability if they promptly respond to valid takedown notices.

Pursuing legal action against Chinese infringers may involve navigating the complexities of international law. While U.S. sellers can initiate legal proceedings in the United States, enforcing judgments in China can be challenging.

Once you confirm ownership, you can take the following steps to determine infringement:
